RESOLUTION ADOPTING VILLAGE
FREEDOM OF INFORMATION ACT (FOIA) PROCEDURES AND GUIDELINES
WHEREAS, the Village Council of the Village of Mendon (“Village”) deems it appropriate and in the interests of the Village to adopt a FOIA Policy to comply with state law changes to the Michigan Freedom of Information Act, Public Act 442 of 1976 (“FOIA”) as amended and to update its FOIA forms and documents accordingly.
NOW, THEREFORE, BE IT HEREBY RESOLVED AS FOLLOWS:
- FOIA Coordinator – The Village Manager is the designated FOIA Coordinator for all general Village FOIA Requests. The Village Police Chief is designated as FOIA Coordinator for all police-related FOIA requests. The Village Manager & Police Chief are authorized to designate an assistant(s) in order to respond to FOIA requests
- Procedures and Guidelines and Public Summary – The Village Council adopts the FOIA Procedures and Guidelines and Public Summary attached to this Resolution as the general procedures and guidelines to be followed for all Village FOIA requests.
- Both the Procedures and Guidelines and Public Summary shall be available for viewing on the Village website at https://mendonmi.us/. Copies of these documents are available free-of-charge at the office of the Village Manager.
- Procedures and Guidelines and Public Summaries shall be amended, as necessary by the Village Council in accordance with the Michigan Freedom of Information Act.
- FOIA Forms – The Village Council adopts the attached FOIA forms which may, but are not required to be utilized in connection with FOIA requests made to the Village:
- Request for Public Records Form
- Notice to Extend Time for Response to FOIA Request
- Notice of Denial FOIA Request
- Cost Itemization detail
- FOIA Appeal Form – Denial of Records
- FOIA Appeal Form – Excessive Fee
- FOIA Appeal Extension Form
- Public Summary
- Form Availability – Copies of FOIA forms to be utilized by the public shall be available free-of-charge at the office of the Village Manager and may be posted on the Village website.
- Form Amendment – The FOIA forms shall be amended as necessary by the FOIA Coordinator in accordance with the Michigan Freedom of Information Act, as amended.
- Appeals – Appeals of both denials and excessive fees may be made to the Village Council. Appeals must be in writing and must contain the word “Appeal” along with the reasons for the appeal.
- Record Retention – All FOIA requests, responses, and records shall be retained by the FOIA Coordinator for a minimum of one year.
- All resolutions or parts of resolutions in conflict with this Resolution are hereby repealed.
- This Resolution replaces any prior FOIA resolution and is effective upon the date of adoption hereof.
Motion was made by Leo, seconded by Batten to adopt the foregoing Resolution.

The Village President declared the motion carried and the resolution duly adopted.
