Resolution # 2026-04

A RESOLUTION TO ESTABLISH WILDS PROPERTY STREETS, AUTHORIZE LAND ACQUISITION, AND DIRECT THE RECORDING OF STREET RECORDS.

​WHEREAS, pursuant to the Michigan General Law Village Act (Act 3 of 1895, MCL 67.12), the Village Council has the authority to lay out, establish, and open streets within the Village whenever it deems such action a public improvement or necessary for public convenience; and

​WHEREAS, a request has been made to establish new public streets generally located at the corner of Vinewood Drive and Cloverdale Drive, and the south end of Locust Street proceeding West  (the “Proposed Streets”) to facilitate proper zoning alignment and future orderly development within the Village; and

​WHEREAS, the Village Council finds that the establishment of the Proposed Street serves a public purpose by ensuring adequate access, utility connectivity, and adherence to the Village Master Plan.

​NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MENDON:

  • ​Establishment of Street: The Village Council hereby establishes and lays out the public streets to be named in the future, as shown in the drafted sketch attached hereto as Exhibit A.
  • ​Authorization of Survey and Recording: The Village Clerk is directed to cause a formal survey and boundary description of the street to be completed and to record the same in the official “Book of Street Records” pursuant to MCL 67.14.
  • ​Authorization to Acquire Land: The Village Manager is authorized to negotiate for the acquisition of the necessary right-of-way. This authority includes:
  • ​Accepting a voluntary Deed of Dedication from the property owner(s).
  • ​Issuing a “Good Faith Offer” for the purchase of the land if dedication is not provided, based on a certified appraisal or reasonable market analysis.
  • ​Establishment of Grade: The Village Engineer is directed to determine the proposed grade of the street. Upon completion, the President and Clerk are authorized to sign the grade record and file it in the Clerk’s office pursuant to MCL 67.15.
